1. Introduction & Acceptance of Terms

These Terms & Conditions apply to all services, products and facilities provided by HYPE Fitness Limited (“HYPE Fitness”, “we”, “us”, “our”), including but not limited to:

  • Studio classes

  • Memberships and subscriptions

  • Class passes

  • Personal training and private sessions

  • Workshops, masterclasses and events

  • Parties

  • Online programmes (including HYPE at Home)

  • Gift cards and account credit

  • Use of the HYPE Fitness website

By creating an account, booking a class, purchasing a service, attending any session (in-studio or online), or using our website, you confirm that you have read, understood and agree to be bound by these Terms & Conditions, our Booking & Cancellation Policy, and our Privacy Policy.

2. Payment for Services

2.1 Payment Methods

HYPE Fitness offers the following payment options:

Online Payments

  • All classes must be paid for at the time of booking

  • “Unpaid” bookings are not permitted

  • Payments can be made via PAYG, class passes or memberships

  • Please refer to the timetable for class availability

In-Studio Payments

  • You may pay in person for the class you are attending or future bookings

  • Payment may be made by cash or card only

  • Walk-in attendance is permitted, but class spaces are not guaranteed

3. Pricing Options

3.1 Pay As You Go (PAYG)

  • One-off payment for a single class

  • Available for adult and child classes

3.2 Class Pass Packs (Adult & Child)

  • 10-class packs expire 4 months from date of purchase

  • 5-class packs expire 2 months from date of purchase

  • Unused credits expire automatically and cannot be refunded, transferred or extended

  • “Use it or lose it” applies so please note your expiry date on your account, or in purchase receipt emails

  • We may apply discretionary extensions to class pass expiry dates in circumstances where there is illness or injury, and a medical note will be required as proof. Please email this to info@hyp-fitness.com with your request before the expiry of your pass. Any expiry extension requests received after passes have expired will not be accepted

3.3 Rolling Monthly Membership

(Legacy contracts only: discontinued July 2023)

  • Monthly rolling auto-pay membership

  • Charged monthly and cancellable at any time via your online account

  • Contract details are stored in your online booking account and will have been emailed to you for your records at the time of purchase

  • Memberships are governed by both these Terms & Conditions and the individual contract agreed at sign-up

  • Access and use of the membership is non-transferable and non-refundable

3.4 Six or Twelve Month Memberships

  • Fixed-term contracts for 6 or 12 months with no refunds due on instalments regardless of individuals use of the membership

  • Monthly payments on your selected billing date

  • Access to fitness classes only unless otherwise specified

  • A joining fee may apply

  • Memberships are governed by both these Terms & Conditions and the individual contract agreed at sign-up

  • Access and use of the membership is non-transferable and non-refundable

3.5 Annual Flex Membership

  • 12-month rolling subscription

  • Provides discounted PAYG and class pass pricing and well as other membership perks

  • Discounts may be shared with friends and family

  • Automatically renews every 12 months unless cancelled

  • Memberships are governed by both these Terms & Conditions and the individual contract agreed at sign-up

  • Access and use of the membership is non-transferable and non-refundable

4. Membership Cancellations & Changes

4.1 Rolling Monthly Membership

  • May be cancelled via your online booking account (please check your contract terms)

  • Cancellation must be completed no later than one day before your billing date

  • If you cancel after the cut-off, your next payment may be taken and will cover the next month

  • If you experience difficulties, email info@hype-fitness.com noting your notice period required to cancel in your contract agreed at sign-up

4.2 Six or Twelve Month Membership Termination

Six or Twelve month memberships auto-renew at the end of each contractural term. You may give notice to cancel an auto-renewal via email to info@hype-fitness.com no later than 7 days before your renewal date. Any requests received later than 7 days before your renewal date will not be accepted and a new term will apply.

You may request early termination once at least 50% of your contract term has been completed and paid in full, with no arrears.

An early-termination fee will apply as follows:

  • Active, Prime, Fitness or Kids memberships: £15 per remaining month (maximum £90)

  • Aerial / Pole / Bungee / Combo memberships: £20 per remaining month (maximum £120)

The termination fee must be paid in full before cancellation is processed. No further monthly payments will be taken once cancellation is confirmed.

Financial Hardship

If you are experiencing genuine financial hardship (e.g. redundancy, loss of income, receipt of Universal Credit), the termination fee may be waived at HYPE Fitness’ discretion. Supporting documentation must be emailed to info@hype-fitness,com for consideration.

Membership Freeze

  • One month freeze permitted at any time for illness, injury, holiday etc

  • Freezes pause payments for one month

  • An additional month is added to the contract term

  • Freezes longer than one month may be applied on a discretionary basis by HYPE Fitness in the case of illness or injury, and a medical note will be required as proof. Please email this to info@hyp-fitness.com with your request

4.3 Annual Flex Membership

  • Non-refundable once purchased

  • Auto-renewal must be cancelled via your online account any time up until the day before renewal or by emailing info@hype-fitness.com at least 7 days before renewal. Any requests in writing received later than 7 days before your renewal date will not be accepted and the renewal will apply.

5. Refund Policy

If you want to cancel a distance selling contract (i.e on online purchase through our website or app, or a purchase made over the phone or email), you usually have a legal right to do so ‘unconditionally’. This means you can cancel without giving a reason. But it’s only unconditional for a certain amount of time after a distance selling contract is ‘performed’. A contract is ‘performed’ when you’ve received the goods or services you ordered. This time period is known as the ‘cancellation period’ or ‘cooling-off period’ and is typically 14 days.

For the purpose of this policy, HYPE Fitness' service access is instantly delivered to you at the point of payment. Therefore you agree to waive-off your rights for cancellation even within the cooling off period of 14-days. If your service has not been delivered (e.g. you have the wrong service, membership or pass), please email info@hype-fitness.com and we shall amend your order to the correct one. If you can still prove that the correct service has not been delivered to you within 14 days of purchase, HYPE Fitness may at it's discretion provide you with a refund which shall be sent to you within 14 days of final proof of non-delivery. Please allow a period of up to 10 working days of issuing the refund for the balance to appear in your account due to bank processing times.

6. 6 Week Transformation Challenge

6.1 Programme Structure

  • Duration: 6 weeks from your selected start date

  • Access to:

    • Premium small group PT sessions

    • Full fitness timetable

    • 36 booking credits (maximum 6 per week)

  • Minimum attendance requirement: 3 sessions per week

  • Access to the online Challenge Hub, including nutrition resources, support groups, progress tracking and HYPE at Home

  • The 6 Week Challenge ends 6 weeks after your start date unless a discretionary extension is applied by HYPE Fitness.

  • Once the program ends, you may choose to continue access to HYPE Fitness by opting for a separate membership, class pass or PAYG package.

6.2 Booking, Payment & Deposits

  • A space must be secured by either:

    • Full payment, or

    • A £50 non-refundable deposit

  • Remaining balance must be paid or payment instalments set up within 7 days of the start date

  • You authorise HYPE Fitness to charge your stored card if payment arrangements are not completed within 7 days of the start date

6.3 Membership Credit Incentive (Optional)

Upon successful completion, the total challenge fee may be credited towards a 12-month membership only if all conditions are met, including attendance, progress tracking, goal completion and marketing consent. You understand that upon successful completion of the program, should you choose to remain a member, your total payment for the challenge may be taken off a 12-month membership as an offer of credit. To qualify for this offer, you must complete the following:

  • You attend a minimum of 3 training sessions/classes per week throughout the 6 weeks

  • You complete full progress tracking for all 6 weeks on the online platform including uploading weight, body measurements and photographs each time and following all training steps

  • You meet your personalised goals set during your consultation, and logged during your progress tracking

  • You provide a video testimonial plus Facebook/Google review and give express permission for HYPE Fitness to share your testimonials, results and your before & after images for the purpose of promoting HYPE Fitness and the challenge. This may include the use on the HYPE Fitness website, social media, printed materials and email campaigns and other marketing methods. If you submit content to us (e.g. testimonials), you grant us a non-exclusive licence to use it for the purpose you submitted it, unless agreed otherwise.

7. Gift Cards & Account Credit

  • Gift cards and credit may be used against any bookable service

  • Valid for 12 months from purchase

  • Non-refundable and non-transferable

  • Expired credit cannot be reinstated

8. Special Offers & Introductory Deals

8.1 Introductory Offers: Trial Passes

  • One purchase per customer only

  • Access begins on activation date and ends 7 days later

  • Does not auto-renew

  • Non-refundable once purchased

  • Membership rules, booking and cancellation policies apply during the trial period

8.2 Promotional Membership Offers

  • Offers apply to new contracts unless stated otherwise

  • Upgrades during a contract are permitted (upgrade definition: increasing the cost and service provision of your contract)

  • Downgrades apply only at the end of the existing contract term (downgrade definition: decreasing the cost and service provision of your contract)

9. Customer Accounts & Responsibility

  • Customers must maintain accurate and up-to-date account details

  • Accounts and memberships must not be shared

  • Each individual attending must have their own account

  • Children must be booked under their own accounts or through a parents family account

  • You are responsible for managing your bookings and notifications

  • It is strongly recommended that you opt-in to auto-emails on your member account so that you receive notifications about bookings, especially if you gain a place after being on the waiting list. HYPE Fitness will not credit payments to you if you have removed your email address or have chosen to opt-out from booking alert emails, and subsequently miss your class. It is your responsibility to be aware of and manage your bookings and adhere to the HYPE Fitness Booking and Cancellation Policy.

  • HYPE Fitness do not allow multiple bookings for the same class under one customer's account. You are not permitted to share your account or membership with anyone else. For safeguarding, health&safety and insurance purposes HYPE Fitness must have a record for each individual customer that attends classes with their own account so that HYPE Fitness ensures the correct health information for each customer and emergency contact information is on file. If you are booking a space in classes for your child you must create an individual account for your child and book them under that account, not under your own account.

10. Booking & Cancellation Policy

10.1 Class Bookings

  • Bookings must be made online or at reception

  • Waiting lists operate where classes are full

  • You are responsible for checking your emails and managing your space on a waiting list, and HYPE Fitness are not responsible if you can no longer make it. If you unsubscribe from notification emails, then you must ensure you only remain on a waiting list if you intend to attend the class if a space is gained, and monitor your booking account to find out if you have gained a space.

  • If you unfortunately do not gain a space in class from a waiting list, any payments made via PAYG or a pass for your wait-list space will be automatically credited back to your member account to use for a future booking instead.

  • Please note that all changes to bookings must be made on your online account only and it is your responsibility to manage your bookings. HYPE Fitness cannot accept cancellations or changes to bookings via phone, text or email as these messages may not be picked up in time. Please only contact HYPE Fitness via phone or the studio email address if you have extreme difficulty in accessing your online account. Please do not contact staff members through social media or their direct phone number for any enquiries regarding your account or the studio as they are not always available or able to help. For HYPE Fitness to deal with your enquiry effectively, your questions will only be answered if you contact HYPE Fitness directly via phone or email to info@hype-fitness.com

10.2 Booking Cancellations

Booking cancellations must be made at least 12 hours before class start time with no exceptions.

PAYG / Pass Holders:

  • Late cancellation or no-show results in loss of payment or credit

Membership Holders:

  • Three late cancellations/no-shows allowed per calendar month

  • After three, a £5 no-show fee applies per occurrence

  • Charges are automatically taken from stored payment details

  • Loss of membership booking credit for the class will also apply in addition to strikes and any charges due

11. Private Training, Workshops, Parties & Events​

11.1 Private Classes & Personal Training
  • PT bookings require a studio booking fee plus payment directly to the instructor to confirm your booking

  • The instructor will contact you after you have paid the booking fee to inform you how to make payment to them. Please note that if the instructor does not receive full payment to themselves by 12hrs before the appointment time, your appointment is not confirmed and we have the right to cancel your booking with no refund of the booking fee from HYPE Fitness. 

  • HYPE Fitness operates a 12hr cancellation policy for all private and PT appointments. If you cancel more than 12hrs before the booking, you will receive a credit onto your booking account to re-book for a future date. HYPE Fitness does not issue refunds for booking fees. If you cancel less than 12hrs before the booking or fail to pay the remainder of the balance to the instructor, the payment will not be credited to your booking account and payment is lost.​​

11.2 Workshops & Masterclasses
  • Workshops and masterclasses are non-refundable but may be transferred to an alternative date as long as your space is cancelled more than 12 hours before the start time. Any late cancellation or no show will result in loss of payment

  • Payment must be made in full at the time of booking to secure your space

11.3 Parties & Private Events​
  • Payment must be made in full at the time of booking for the full party package price.

  • If the party is cancelled more than 7 days in advance of the original booking date: you can either transfer to a new date for free, or cancel and receive a refund for the amount paid minus a £50.00 administration fee,

  • If the party is cancelled less than 7 days in advance of the original booking date: HYPE Fitness will not issue any refund but you can transfer to another date for a £50.00 administration fee. If you do not contact HYPE Fitness to arrange a transfer of your booking by the date of the original party, then the payment is lost and you cannot transfer to another date.

12. Health, Safety & Liability

You confirm that:

  • You are physically fit to participate

  • You have disclosed all relevant medical information

  • You accept the risks associated with physical activity

  • You will complete a health questionnaire at the studios before commencing in-person classes, declare any health conditions, injuries or medication, provide emergency contact details and fill in a new form any time your health changes. You must ensure that you keep HYPE Fitness updated at all times for any health changes or injuries. HYPE Fitness will advise you of any classes you may need adaptations for or should not attend.

  • You must bring any emergency medication (such as EpiPens, Inhalers etc) with you to classes and be able to self-administer this medication as the team will not be able to do this for you.

  • If a child (aged under 16 years) is attending classes, they must have a heath questionnaire completed by their parent or legal guardian. If they require any emergency medication (e.g EpiPens, Inhalers etc) these must be brought with them. The child must be able to self-administer these medications, or a parent or legal guardian must stay on the premises to be able to administer this medication for them

  • All information disclosed is securely and confidentially held for the purpose of ensuring your health and wellbeing at the studios

HYPE Fitness has a specific guide and policy for any customers who are pregnant or have recently had a baby: Pre/Post Natal Policy

By becoming a customer of HYPE Fitness (either in-studio or online), you agree to the following Liability Waiver:

​

I do hereby declare to be physically sound and not suffering from any condition, impairment, disease or other illness (other than those declared above) that would prevent my participation in class. I acknowledge that I have either had a physical examination and have been given my doctors permission to participate, or that I have decided to participate without the approval of my doctor and do hereby assume all responsibility for my participation in class.

​

Group exercise classes at HYPE Fitness Limited may involve strenuous physical activity, including but not limited to, interval training, muscular strength, endurance training, cardiovascular conditioning and aerobic training. Enrolment and participation in the class is voluntary and is in no way mandated by HYPE Fitness Limited. This form has been completed with honest answers to the best of my knowledge. If there is any change to my health (including pregnancy) in the future, then I shall inform HYPE Fitness Limited immediately and complete a new questionnaire with the details and seek further advice from a health professional and potentially cease attending classes where necessary. Participation in the class therefore is on my understanding that if any injuries occur as a result of my attendance, HYPE Fitness Limited and its instructors are released from any liability now or in the future for any injuries or conditions that may be obtained from my participation.

I agree to respect the facilities, equipment and classes provided by HYPE Fitness Limited and follow directions from the staff and instructors at all times and to not deviate from instructions given. I understand that if any damage is caused to equipment or the premises due to not following staff or instructors directions, then I may be held liable for any costs for repair or replacement. I understand that all jewellery must be removed during pole and aerial based classes. I agree to not film or video without permission from the instructor and shall only do so during allotted times in the class to respect other participants privacy. I understand that chewing gum and food is not permitted inside the studios, and I will dispose of all rubbish in the bins provided. I understand that HYPE Fitness Limited are not liable for any lost or damaged personal possessions. I understand that I must arrive on time to classes and that late arrival may result in entry being denied to the class without any refund due. I agree to behave respectfully at the studios to all staff and other customers, and I understand that rude, offensive or abusive language or behaviour will not be tolerated.

If I am bringing children to the studio whilst I participate in classes, I understand that they must stay in the reception area only and must be well behaved and not disruptive to other members or staff during the classes. I understand that any children are my own responsibility only and HYPE Fitness Limited and its staff/instructors are not liable for their behaviour or safety. I understand that HYPE Fitness Limited and it’s staff/instructors reserve the right to ask any disruptive or poorly behaved children to leave the premises.

For any online classes and programs with HYPE Fitness:

​

By participating in any online classes, I am fit and well with no medical conditions. If I have any injuries or medical conditions, I will seek the advice and approval of a qualified health professional before completing any of the online content or classes. It is my responsibility to ensure that any environment I am following the online HYPE at Home Program in, is safe and secure, free of any slip or trip hazards, and that the equipment I use is suitable, safe and free of any damage. 

 

I do hereby declare to be physically sound and not suffering from any condition, impairment, disease or other illness (other than those declared above) that would prevent me from following the online content or classes. I acknowledge that I have either had a physical examination and have been given my doctors permission to participate, or that I have decided to participate without the approval of my doctor and do hereby assume all responsibility for my participation. My use of the HYPE Fitness online content or classes is therefore is on my understanding that if any injuries occur as a result of my participation, HYPE Fitness Limited and its instructors are released from any liability now or in the future for any injuries or conditions that may be obtained from my participation.

I have read, understood and agree to the Booking & Cancellation Policy, full Terms & Conditions and Privacy Policy for HYPE Fitness Limited (displayed on the website www.hype-fitness.com for me to view at any time.)

13. Additional Policies, Conduct, Behaviour & Termination

  • HYPE Fitness reserves the right to refuse entry to any members who turn up late to class and miss the warm-up or a significant portion of the class content, or a t a time which will disrupt the class taking place. This is for your Health & Safety, to respect other members who have arrived on time and not disrupt the flow of the class. You must stay for the full duration of the class so that you are safely cooled-down at the end. If you become unwell or need to leave early, you must speak to a member of the HYPE team who will advise on next steps, and record you leaving early from class in the studio's Incident Book.

  • If you have a Membership and are changing banks or if your card is due to expire, you must update your card details on your account immediately (either with the studio reception team or online). If this does not occur, HYPE Fitness shall suspend your account and you will no longer be able to book or attend classes until the new details are stored. A £10 late fee will apply if you fail to provide a valid credit card or debit card information within 7 calendar days of the original rejection date. Your membership will be deactivated if the monthly account payment becomes more than 30 calendar days late and HYPE Fitness will take further steps, including (but not limited to) legal action to claim the fees due as per the Contract Agreement terms.

  • You must include a current and valid email address on your account. Please advise HYPE Fitness if your email address or home address changes, or if your surname changes through marriage. HYPE Fitness reserves the right to store your card details on your member account, and you authorise HYPE Fitness to take payment for any 'unpaid' class bookings. If you do not wish payment to be automatically taken for 'unpaid' bookings, then please cancel your space instead as it is against our booking policy to have 'unpaid' class reservations on member accounts. Every credit/debit card number entered is encrypted and kept in a secure format offsite, adhering to the industry’s most stringent PCI standards.

  • Any customers under the age of 16 years must have an account created and operated by a parent, guardian or carer. As a parent, guardian or carer, you may stay on site during your child's class if you wish, but you must remain in the reception area only for the duration of the class and do not enter the studios as this causes distraction and disruption. You must not book children into classes under your own name, but instead you must create a separate booking account for each child attending.

  • If a child is under the age of 16, in some circumstances they may attend certain adult classes with permission from the instructor (please check this in advance) but they must be accompanied in the class by another adult (parent, guardian, or carer) either as another paying customer, or by signing an agreement to allow their child to participate in an adult class.

  • You are expected to wear appropriate clothing for working out in classes, especially the correct footwear (trainers or sports shoes). Items such as jeans and flip-flops or clothing that could catch on equipment are not acceptable items of apparel, as they could pose a health and safety risk. Instructors and the HYPE Fitness Team have the discretionary power to ask members wearing inappropriate clothing or footwear to leave the studio.

  • Opening hours, access, and the timetable are subject to change and no amount or number of classes on the timetable are guaranteed as provision of a service.

  • HYPE Fitness does not offer refunds for PAYG class bookings, class passes or membership fees unless processed by HYPE Fitness in error. This does not affect your statutory rights.

  • If you make a payment using someone else’s bank account or credit/debit card, you must have their permission to do so.

  • Memberships/payment options cannot be transferred to or shared with another person.

  • HYPE Fitness are not legally obliged to compensate you for any service, facility or item of equipment that is unavailable for reasons of health and safety, or any class that is cancelled for reasons beyond our control such as (but not limited to) government or local council shutdown of businesses, any public health or safety reason, any damage and closure of the premises, or any instructor unavailability.

  • HYPE Fitness is not obliged to cancel or refund any memberships when any service, facility or item of equipment is unavailable for reasons of health and safety, or any class is cancelled for reasons beyond our control such as (but not limited to) government or local council shutdown of businesses, any public health or safety reason, any damage and closure of the premises, or any instructor unavailability. If a class (or classes) cannot take place for any period in the HYPE Fitness studios, either the provision of the studios for individual functional training or online streamed classes by the instructors are deemed to be suitable provisions of the service or class as part of any membership contract at HYPE Fitness Limited.

  • HYPE Fitness will not compensate you for loss, damage or personal injury where no negligence on the part of the company can be proven. All instructors and staff hired by HYPE Fitness are freelance contractors and are required to hold their own individual liability insurance policies and hold all necessary qualifications and certifications. Nothing in this waiver limits liability where it cannot legally be limited, including for death or personal injury caused by negligence of HYPE Fitness Limited.

 

HYPE Fitness reserves the right to suspend or terminate your access to the studios without refund where there is:

  • Abuse of policies, including but not limited to, repeated failure to pay fees, deliberately or negligently damage or misuse equipment, or seriously or repeatedly break these terms and conditions of use, or your membership agreement.

  • Unsafe, harmful, abusive or disruptive behaviour in any way

  • Account misuse or impersonation. The person attending the class must be the person listed on the account and booking

  • Commercially detrimental conduct

Any suspension or ban from the studios will result in the immediate termination of any membership or booking account access. No refunds will be given, and any outstanding fees, fees associated to a remaining membership term, repair costs, administration fees and legal fees will be charged to the offending member.​ HYPE Fitness will not refund any prepaid PAYG, class pass or membership payments that you have made.

14. Photography & Marketing

HYPE Fitness may capture photographs or video during classes and events for marketing purposes. By booking and attending classes at HYPE Fitness, you consent to these images being collected, however you must inform HYPE Fitness in writing if you wish to opt-out. If you submit content to us (e.g. testimonials), you grant us a non-exclusive licence to use it for the purpose you submitted it, unless agreed otherwise.

We also capture CCTV recording 24/7 in our business premises for the purposes of safety and the prevention of crime. There is signage dispalyed throughout the premises to remind that CCTV is in use.

15. Website Terms

  • HYPE Fitness invites you to visit its website. Access to and use of the site is subject to the terms and conditions outlined herein and all applicable laws. HYPE Fitness reserves the right to modify these terms and conditions as needed by updating this notice. This is an offer made by HYPE Fitness to you, under which you are invited to browse, peruse and interact with our website for your own personal edification, guidance, information and communication with HYPE Fitness.

  • This offer is expressly conditional on your acceptance of these terms and conditions. This Agreement represents the entire agreement between you and HYPE Fitness concerning access to the HYPE Fitness, and takes precedence over all such existing communications and/or agreements.

  • You acknowledge that, whilst every effort is made to ensure that all information contained in the HYPE Fitness website is accurate and up-to-date, HYPE Fitness makes no warranty as to its accuracy, and you accept that any and all use of information contained on the HYPE Fitness website is at your own risk.

  • HYPE Fitness shall not be liable for any direct or consequential loss arising from your access to and/or use of or inability to access and/or use the HYPE Fitness website or any erroneous or omitted information contained on the HYPE Fitness website.

  • You accept that the entire content of the HYPE Fitness website is protected by copyright and that HYPE Fitness is either the proprietor or licensee of all copyright in the material contained therein.

  • HYPE Fitness reserves all its rights as copyright proprietor of the HYPE Fitness website and prohibits without limitation downloading, distribution, exhibition, copying, adaptation, reposting, modification of and dealing in any copyright material contained therein, save as expressly provided herein without the express written authorisation of HYPE Fitness.

  • You are advised that all communications made via the HYPE Fitness website and/or email, including but not limited to competition entries, is strictly on a non-confidential basis and you hereby grant to HYPE Fitness an exclusive perpetual license to use the content of any such communication for any purposes whatsoever.

  • You acknowledge that HYPE Fitness reserves all its rights as proprietor of all its trademarks and logos.
